Pardons & Expungements in Delaware

If you've had a criminal charge dismissed or you're given a probation before judgement (PBJ) disposition, or found not guilty by a court, you are entitled under Delaware law to have all evidence expunge from the public view records of any agency that placed information into its records as a result of your offense. If you do not apply for expungement these cases remain on record within the criminal justice system and are open to public view.

If you have been convicted of a criminal offense, our Governor has the authority to grant a full pardon or grant a partial or conditional pardon after receiving the appropriate application. After a period of time, that pardon may also be eligible for expungement.
